IDEA Law by KELLY JEAN SULLIVAN

Students with disabilities have specific rights and protections under various laws to ensure they receive appropriate education and support in school. One key piece of legislation is the Individuals with Disabilities Education Act (IDEA), which mandates that public schools provide free appropriate public education (FAPE) tailored to the individual needs of students with disabilities. This includes the development of an Individualized Education Program (IEP), which outlines the specific accommodations, modifications, and services required for the student to succeed academically. Schools are also required to provide these students with access to the least restrictive environment (LRE), meaning they should be included in general education settings to the maximum extent appropriate. Additionally, Section 504 of the Rehabilitation Act and the Americans with Disabilities Act (ADA) provide further protections against discrimination, ensuring that students with disabilities have equal access to educational opportunities and resources.

Parents of students with disabilities have significant rights to participate in and influence their child's education. Under IDEA, parents are considered key members of the IEP team and have the right to be involved in all aspects of their child's educational planning. They must be notified of any evaluations, meetings, and changes to their child's educational placement. Parents also have the right to access their child's educational records and to request independent educational evaluations if they disagree with the school's assessment. Moreover, if parents feel that their child's rights are being violated, they have the option to pursue dispute resolution mechanisms, including mediation, due process complaints, and filing grievances with the Office for Civil Rights. These protections ensure that parents can advocate effectively for their child's educational needs and work collaboratively with schools to secure appropriate support and services.
